The central government has firmly told the Supreme Court that the judiciary cannot dictate when and on which matters the President may seek advice from the apex court. Objecting to a ruling that compels the President to consult the Supreme Court on the constitutionality of bills, the Centre argued that courts cannot direct the President on how to exercise his discretion.
Additionally, the government stated that imposing strict timelines on the President and Governors to act on bills passed by state legislatures would result in "constitutional disorder." It emphasized that such directives would amount to one arm of the government exercising powers not granted by the Constitution.
These statements were made in the Centre’s written submission related to the President’s constitutional powers, specifically addressing whether timelines can be enforced in handling bills passed by state assemblies.
