The Madhya Pradesh High Court has said in an important order that unreserved (general) posts in all selection examinations of the state government and the court should be filled only with talented candidates from all categories.
The purpose of this order is not to compromise with the future of the reserved category candidates. The division bench of Chief Justice Suresh Kumar Kait and Justice Vivek Jain has taken this decision in reference to an order of the Supreme Court, which provides clear guidelines on such matters. This order has been passed on the basis of the Supreme Court's decision of May 1, 2024 against the Madhya Pradesh government. The Supreme Court had said that unreserved posts should be filled with qualified candidates from all categories in every stage of selection examinations. After this order, the High Court, while hearing the PIL, implemented it. The order said that the future of the reserved category candidates cannot be tampered with.
In this case, the Scheduled Caste and Tribe Officers-Employees Association (AJAKS) had filed a petition challenging the unfair reservation applied in the recruitment examinations being conducted by the High Court. The petition also said that in the Civil Judge Recruitment Examination-2022, candidates from the unreserved category have been selected, but no candidate from the reserved category was selected, while their marks limit was equal to that of the unreserved category candidates. The High Court has decided to apply this order to all the upcoming recruitment examinations. Under this, unreserved posts in all selection processes will be filled with fully qualified candidates, so that candidates from all categories can get equal opportunity.
