Supreme Court Strikes Down Native Reservation in PG Medical Admission

The bench of Justice Hrishikesh Roy, Justice Sudhanshu Dhulia, and Justice SVN Bhatti has abolished the native reservation in post-graduate medical courses in states. The Supreme Court declared this reservation a violation of Article 14 of the Constitution, and now students will no longer be able to avail of this reservation for admission.

The Supreme Court has struck down the native reservation under the state quota for post-graduate medical courses, stating that it violates Article 14 of the Constitution. As a result, students will no longer be able to use this reservation for their admission process.

The bench stated, "As citizens and residents of India, we have the right to choose to live anywhere. The Constitution also grants us the right to choose educational institutions across India." The court further emphasized that there is no such concept as a state resident; we all belong to India, and we have the right to live and study anywhere within the country.

The court also mentioned that reservations for residents of specific states could be considered for undergraduate courses, but not for post-graduate courses. Given the importance of expert doctors, the court ruled that reservations based on residence for postgraduate courses violate Article 14.

This Supreme Court decision ensures that PG medical admissions will be based solely on merit, specifically NEET scores, rather than the state-based native reservation quotas. The ruling applies only to future admission processes. Students who have already gained admission under the native reservation will not be affected by this decision, and they can continue with their studies as per the previous regulations.
