Restricted Access to Election E-Documents
Electronic documents related to elections are no longer accessible to the general public. The Indian government has amended the election rules to restrict public inspection of documents such as CCTV footage, webcast footage, and video recordings of candidates to prevent their misuse.
Documents Accessible to Candidates
Based on the recommendation of the Election Commission, the Ministry of Law and Justice has amended Rule 93 of the Conduct of Elections Rules, 1961. While documents related to elections were previously open for public inspection, the amendment now imposes restrictions. However, these documents will still be accessible to candidates.
Amendment Triggered by a Court Case
Officials from the Law Ministry and the Election Commission stated that the amendment was prompted by a court case. Although documents such as nomination forms, appointment of election agents, results, and election account details are specified for public inspection under the rules, electronic records like CCTV footage, webcast footage, and video recordings during the Model Code of Conduct period are excluded.
