Now, children under the age of 18 will need to obtain their parents' consent to open accounts on social media. The central government has drafted rules under the Digital Personal Data Protection Act (DPDP), 2023, which were released on Friday (January 3).

   

The Ministry of Electronics and Information Technology announced in the notification that people can visit Mygov.in to file objections and suggestions regarding this draft. Objections and suggestions will be reviewed starting February 18.

   

The draft also outlines a system for obtaining parental consent. About a year and a half ago, the bill was approved by Parliament. According to the notification, the draft rules were issued based on the powers granted to the central government under Sections 40(1) and 40(2) of the Digital Personal Data Protection Act, 2023.

   

The rules include the requirement for obtaining parental consent and state that parental consent is mandatory for the use of children's data in any form. The Act refers to companies that collect and use personal data as 'data fiduciaries'.

   

According to the draft, data fiduciary companies must ensure that parental consent is obtained before processing any children's personal data. These companies must take appropriate technical and organizational measures to achieve this.
