हाई कोर्ट ने सिविल जज परीक्षा में ओबीसी वर्ग के सभी उम्मीदवारों को एससी-एसटी वर्ग के समान न्यूनतम पात्रता अंक में छूट देने के निर्देश 1 दिसंबर को दिए हैं। इसके साथ ही अब सिविल जज की प्रारंभिक और मुख्य दोनों परीक्षा में भी ओबीसी को अन्य आरक्षित वर्ग के समान छूट मिलेगी। मुख्य न्यायाधीश रवि मलिमठ व न्यायमूर्ति विशाल मिश्रा की युगलपीठ ने इस संबंध में हाई कोर्ट प्रशासन को तीन दिन के भीतर अधिसूचना जारी करने के निर्देश दिए।

संशोधित नियम के तहत सिविल जज भर्ती परीक्षा में शामिल होने के लिए सामान्य वर्ग के लिए एलएलबी में न्यूनतम 70 प्रतिशत (बिना एटीकेटी) अंक निर्धारित किए गए हैं। वहीं एससीएसटी के लिए 50 अंक की योग्यता है। अब ओबीसी उम्मीदवार को भी एससीएसटी के समान छूट मिलेगी। याचिकाकर्ता की ओर से अधिवक्ता रामेश्वर सिंह ठाकुर व विनायक प्रसाद शाह ने पक्ष रखा। उन्होंने दलील दी कि ओबीसी भी आरक्षित वर्ग है, इसलिए उसे अनारक्षित वर्ग में नहीं रखा जा सकता। उन्होंने बताया कि संशोधित नियम के तहत जिन उम्मीदवारों के पास तीन साल के वकालत का अनुभव है तो वे केवल एलएलबी उत्तीर्ण होने पर भी सिविल जज की परीक्षा के लिए पात्र होंगे।

The High Court has given instructions on December 1 to give relaxation in minimum eligibility marks to all the candidates of OBC category in the Civil Judge examination at the same level as SC-ST category. Along with this, now OBC will get the same relaxation as other reserved categories in both the preliminary and main examination of Civil Judge. The double bench of Chief Justice Ravi Malimath and Justice Vishal Mishra directed the High Court administration to issue a notification in this regard within three days. Under the amended rule, a minimum of 70 percent marks (without ATKT) has been prescribed in LLB for the general category to appear in the Civil Judge Recruitment Examination. Whereas for SCST the eligibility criteria is 50 marks. Now OBC candidates will also get the same relaxation as SCST. Advocates Rameshwar Singh Thakur and Vinayak Prasad Shah appeared on behalf of the petitioner. He argued that OBC is also a reserved category, hence it cannot be kept in the unreserved category. He said that under the amended rule, candidates who have three years of advocacy experience will be eligible for Civil Judge examination even if they have passed LLB only.
